A federal judge appointed by former president George w. Bush overturns a 32 year ban on assault rifles. The federal judge Honrable “Roger Benitez” born in Havana Cuba, is a senior United States District judge of the United States district court for the Southern District of California. In the judge’s 94 page ruling, the judge called the ban on assault rifles unconstitutional. The California senior district judge stated in his ruling, that the AR-15 rifles where overwhelmingly used for legal reasons. But 32 years earlier the California lawmakers had a different opinion about AR-15 RIFLES. Back in 1989 the California attorney general office argued, assault weapons as defined by the law are more dangerous than other firearms and are disproportionately used in crimes, mass shootings and against law enforcement, with more resulting casualties. In 1989 the California lawmakers banned the AR-15 rifles stating: barring the assault rifles further the states important public safety interest. Most Californians believe the 1989 ban on assault rifles was prompted by the Cleveland elementary school “mass shooting” in Stockton California. On that day a gunman name Patrick Purdy used an assault rifle and killed five schoolchildren and wounded 32 others. After the shooting Purdy committed suicide by shooting himself in the head on the scene of where his crimes occurred. In may of 1989 California became the first state in the United States to pass an assault weapons law. The law ban weapons defined as assault weapons. It also banned magazines that it classified as large capacity, those able to hold more than 10 rounds of ammunition. Guns and magazines legally owed at the time the law was passed were grandfathered in, if registered with the California department of justice. The Roberti Roos assault weapons control Act of 1989 or AWCA was in place for 32 years until June 4th 2021 the day the judge ruled the ban was unconstitutional. The AR-15 rifles are the jewel of the gun industry and the United States most popular rifle. The AR-15 which stands for ArmaLite rifle was first developed in late 1950s as a military rifle. But the company who manufactured it had little success in selling it. In 1959 the company sold the design to gun manufacturers Colt. Today there are currently at least 23 different models of AR-15 sold to civilians who buy guns in the United States. For Californians who oppose this ruling, its seems as a backlash to all the victims who died at the hands of the AR-15 style rifles. For those who stand up for the second amendment and thier rights to bare arms, this ruling is a new direction and sends a clear message that the gun control laws is a never ending debate.
